Terms of Service

These Terms of Service (“Terms”) set out the agreement between you (“you”, “your”) and Built By Women (“we”, “us”, “our”) governing your access to and use of the website at builtbywomen.org and any related services we provide (together, the “Services”). By using the Services you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree, please do not use the Services.

Acceptance of Terms

By browsing, submitting a contact form, joining our community, or otherwise interacting with the Services, you enter into a binding agreement with us on the basis of these Terms together with any additional written agreements signed between us in relation to a specific engagement. We may revise these Terms from time to time; the current version is always the one published on this page and takes effect immediately on publication. Your continued use of the Services after a change constitutes acceptance of the revised Terms.

The Services We Provide

Built By Women is a community that upskills women in tech by delivering real websites, brands, apps, copy, SEO, hosting and ongoing maintenance for women-owned and women-led businesses. The website itself is an informational and lead-generation platform: it describes our work, showcases our team and sponsors, and allows you to get in touch. Any engagement beyond that — paid work, sponsorship, partnership, or community membership — is subject to a separate written agreement or to the rules of the relevant community space (for example, our Discord server).

Your Account and Communications

Certain features may require you to provide your name, email address and a short message. You agree to provide accurate, current and complete information, and to update it promptly when it changes. You are responsible for all activity that takes place using your contact details. We may communicate with you about your enquiry using the contact details you supply.

Acceptable Use

You agree not to misuse the Services. In particular, you must not: (a) use the Services for any unlawful purpose or in a way that infringes the rights of others; (b) attempt to gain unauthorised access to any part of the Services or any server, computer or database connected to them; (c) introduce viruses, trojans, worms or other malicious material; (d) use the Services to send unsolicited commercial communications or spam; or (e) scrape, copy or redistribute our content other than as permitted by applicable copyright law.

Intellectual Property

All content on the Services — including text, graphics, logos, photographs, audio, video, design elements and software — is owned by Built By Women or our licensors and is protected by copyright, trade mark and other intellectual property laws. Except for the limited licence to view and use the Services for your personal, non-commercial purposes, no rights are granted to you. You may not reproduce, modify, distribute or publicly display any of our content without our prior written consent. Work produced as part of a Built By Women engagement is governed by the separate written agreement for that engagement.

Third-Party Links and Services

The Services may contain links to third-party websites or integrate with third-party services (for example, embedded video players, our Discord server, or analytics providers). We do not control, endorse or assume responsibility for any third-party content, policies or practices. Your interactions with third parties are solely between you and that party.

Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components, nor that any defects will be corrected. Any information provided through the Services is for general informational purposes only and does not constitute professional, legal, financial or other advice.

Limitation of Liability

To the fullest extent permitted by law, Built By Women and its directors, employees, contractors and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising out of or in connection with your use of, or inability to use, the Services — even if we have been advised of the possibility of such damages. Our total aggregate liability to you for all claims arising out of or relating to the Services shall not exceed an amount to be confirmed in writing for any specific engagement, or — for general use of the Services where no such agreement exists — the amount you have paid us in the twelve (12) months preceding the claim.

Indemnity

You agree to indemnify and hold harmless Built By Women and its directors, employees, contractors and affiliates from and against any claims, losses, damages, liabilities and expenses (including reasonable legal fees) arising out of or relating to (a) your breach of these Terms, (b) your misuse of the Services, or (c) your violation of any applicable law or the rights of a third party.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason including (without limitation) if we reasonably believe you have breached these Terms. On termination, the sections of these Terms which by their nature are intended to survive — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnity and Governing Law — shall continue in force.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You and we each agree to submit to the exclusive jurisdiction of the South African courts for the resolution of any dispute arising out of or relating to these Terms or the Services, except that we retain the right to seek injunctive or other equitable relief in any jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, where appropriate, provide additional notice (for example, by email or an in-product notification).
